Terms of Service

1. Acceptance of these terms

Corduroy ("Corduroy," "Cord," "we," "us") is operated by Corduroy Systems, LLC, a Delaware limited liability company. By texting our number, tapping a "Text Corduroy" link, or otherwise using Corduroy, and by using this website (skicorduroy.com), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use Corduroy or this site. If you are using Corduroy on behalf of someone else, you confirm you are allowed to do so. You must be at least 13 years old to use Corduroy, and if you are under 18 you may use it only with a parent or guardian's permission.

2. What Corduroy is, and what it isn't

Corduroy is an informational ski-conditions and local-knowledge assistant that answers questions over text message. It draws on public weather data, snow reports, and general knowledge about mountains and resorts to give you a friendly, best-effort read on conditions.

Corduroy is not professional advice, a mountain guide, a ski instructor, ski patrol, an avalanche-forecasting service, or an emergency service. It is not a substitute for your own judgment, official resort communications, or trained professionals. Do not use Corduroy for safety-critical or emergency decisions. In an emergency, call 911 or contact ski patrol directly.

3. Assumption of risk

Skiing, snowboarding, and related activities are inherently dangerous and involve risks of serious injury or death. Under Maine law, the Skiers' and Tramway Passengers' Responsibilities Act, 32 M.R.S. §15217, a skier is deemed to accept the inherent risks of skiing insofar as they are obvious and necessary. Those risks exist regardless of anything Corduroy tells you.

You understand and agree that you assume all risk arising from your use of Corduroy and from any decision you make based on information Corduroy provides. You are solely responsible for evaluating conditions yourself, following resort rules and signage, and deciding whether, where, and how to ski or ride.

4. Terrain, conditions, and the backcountry

Information about weather, snow, terrain, trail status, and lift or trail openings may be inaccurate, incomplete, delayed, or out of date. Conditions on a mountain change quickly. Whether a trail, lift, gate, or area is open, closed, or safe is determined by the resort and by conditions on the ground, not by Corduroy. We do not guarantee any open, closed, or status information, and Corduroy never certifies any run, trail, or area as open or safe.

Backcountry and out-of-bounds travel is entirely at your own risk. No avalanche forecast covers the terrain Corduroy discusses, and Corduroy does not provide avalanche forecasting. Know before you go: carry proper gear, travel with a partner, get real training, and consult official forecasts and local authorities. Nothing Corduroy says should be read as clearing any backcountry or out-of-bounds terrain as safe to enter.

5. Text messages

Corduroy communicates by SMS and iMessage. Message and data rates may apply, depending on your mobile carrier and plan. Message frequency varies with weather and season. By texting Corduroy or tapping a "Text Corduroy" link, you consent to receive text messages from us at the number you used, including occasional proactive messages about conditions unless you opt out.

Reply STOP at any time to stop receiving messages, and reply HELP for help. Carriers are not liable for delayed or undelivered messages. For full details on our messaging program ("Corduroy ski conditions"), including how you opt in and out, see our SMS opt-in page.

6. Acceptable use

Use Corduroy for its intended purpose. Do not use it for any unlawful purpose, do not try to break, overload, or reverse-engineer the service, and do not use it to harass, impersonate, or harm anyone. We may suspend or stop providing Corduroy to anyone, at any time, for any reason.

7. No warranty

Corduroy is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that Corduroy will be accurate, reliable, uninterrupted, error-free, or available at any given time.

8. Limitation of liability

To the fullest extent permitted by law, Corduroy Systems, LLC and its founders, members, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury, arising out of or relating to your use of, or inability to use, Corduroy, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to Corduroy or these terms will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you; in that case our liability is limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless Corduroy Systems, LLC and its founders, members, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of Corduroy, your violation of these terms, or your violation of any law or the rights of any third party.

10. Disputes and arbitration

Let's talk first. If you have a problem, email us at admin@skicorduroy.com and we will try in good faith to resolve it informally. Please give us 30 days before starting a formal proceeding.

If we can't resolve it, you and Corduroy Systems, LLC agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. You and Corduroy agree that each may bring claims only on an individual basis, and not as a plaintiff or class member in any class or representative action.

You can opt out of arbitration. If you don't want to be bound by this arbitration agreement, email admin@skicorduroy.com within 30 days of first using Corduroy, stating that you opt out and including the phone number you use with Corduroy. Opting out of arbitration will not affect any other part of these terms.

11. Changes to these terms

We may update these terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of Corduroy after a change means you accept the updated terms. If a change materially affects the messaging program, we will let you know consistent with applicable law.

12. Governing law

These terms are governed by the laws of the State of Maine, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provision above. Subject to that arbitration provision, any dispute not resolved by arbitration will be brought exclusively in the state or federal courts located in Maine, and you consent to their jurisdiction.
